    Foreigners who come to our country can stay as long as their visa or visa exemption period allows. Foreigners who wish to stay longer than this period are required to apply to the authorized authorities with the necessary documents and obtain a residence permit as stipulated in the Law on Foreigners and International Protection.

    Foreigners coming to Turkey can stay up to 90 days within 180 days without obtaining a residence permit. However, foreigners wishing to stay longer must obtain a residence permit based on their purpose of stay.

    Applications for the extension of residence permits can be made starting 60 days before the expiration of the current residence permit and must be completed before the expiration date in any case.

     

    A person arriving with a visa can apply for a residence permit within 10 days after their visa expires, but they must pay a penalty. If the delay exceeds 10 days, they must exit and re-enter the country.

    Foreigners married to Turkish citizens are granted the right to a residence permit after fulfilling certain requirements. However, they must first prove their marriage, requiring them to present a marriage certificate and family registry. Foreigners married in Turkey must also have their marriage approved by Turkish authorities. A foreigner married to a Turkish citizen is typically granted a residence permit for 3 years.

    1- Those Coming for Scientific Research: Foreigners coming for scientific research must obtain a permit from the relevant institutions, or if a permit is not required, they should apply with a document explaining the subject of the research. To issue a residence permit for this purpose, the foreigner must obtain a 'Scientific Research' visa from our foreign representations.

    2- Foreigners Who Own Property in Turkey: In case of a request for a residence permit of this type, the property must be residential and used for that purpose. Family members can apply for a residence permit if their names are on the title deed. Family members include the spouse, minor child, and dependent adult child of the applicant.

    3- Foreigners Establishing Business or Business Connections: Foreigners seeking a residence permit for more than three months to establish a business must provide a letter of reference and explanation from the companies they will contact, along with the following documents:

    • Notarized signature circular of the company,
    • Notarized copy of the company’s tax registration,
    • Notarized copy of the company’s activity certificate,
    • Notarized copy of the Trade Registry Gazette.

    4- Foreigners Participating in In-Service Training Programs: Detailed documentation about the training program must be provided by the institution offering the in-service training.

    5- Foreigners Coming for Education or Similar Purposes Under Agreements or Student Exchange Programs to Which Turkey is a Party: The foreigner requesting a residence permit must submit a student certificate from the university. The duration of the residence permit cannot exceed the duration of education or similar purposes.

    6- Foreigners Staying for Tourism Purposes: Foreigners requesting a residence permit for tourism purposes may be required to provide documents and information about their travel plans.

    7- Foreigners Coming for Medical Treatment: Foreigners who do not have a disease that threatens public health must submit information and documents about their illness and treatment process from the hospital. The residence permit is issued according to the treatment period.

    8- Foreigners Who Must Stay in Turkey Due to Judicial or Administrative Decisions: The duration of the residence permit for this purpose is determined based on the duration specified in the decision or request.

    9- Foreigners Switching to Short-Term Residence Permits Due to Losing Family Residence Permit Eligibility:

    10- Foreigners Attending Turkish Language Courses: Foreigners who obtain a visa for Turkish language courses must present a student certificate from courses approved by the Ministry of National Education, and a residence permit can be granted up to two times.

    11- Foreigners Attending Education, Research, Internship, or Courses in Turkey Through Public Institutions: This type of residence permit cannot exceed one year. Information and documents may be requested from institutions.

    12- Foreigners Who Apply Within Six Months After Graduating from a Higher Education Institution in Turkey: A residence permit can be granted for a maximum of one year, only once, to foreigners who apply within six months of their graduation date.

    13- Foreigners Who Are Not Working But Will Invest in Turkey, and Their Foreign Spouse, and Dependent Foreign Children: This type of residence permit can be issued for up to five years at a time.

    14- Citizens of the Turkish Republic of Northern Cyprus: They can be granted a residence permit for up to five years at a time.

    Foreigners who have stayed in Turkey with a residence permit for at least eight years uninterruptedly can be granted a long-term residence permit by the governorship of the province where they reside, upon approval from the Ministry of Interior.

     

    Refugees, conditional refugees, individuals under subsidiary protection, holders of humanitarian residence permits, and those under temporary protection cannot transition to a long-term residence permit.

     

    Long-term residence permits are issued indefinitely.

     

    • Having lived in Turkey with a residence permit for at least eight uninterrupted years (half of the time spent on a student residence permit is counted, and the entire time for other types is counted),
    • Not having received social assistance in the last three years,
    • Having sufficient and regular income,
    • Possessing valid health insurance,
    • Not posing a threat to public order or public security.

    They are not required to perform military service, have the right to vote or be elected, enter public service, or import vehicles duty-free. However, they enjoy the same rights as Turkish citizens, except for these exceptions and social security rights unless otherwise regulated by law.

     

    No, the eight-year continuous residence requirement is not sought in reapplications, and the application is finalized within one month at the latest.

     

    Refugees, conditional refugees, individuals under subsidiary protection, holders of humanitarian residence permits, and those under temporary protection cannot transition to a long-term residence permit.

     

    Foreigners with long-term residence permits enjoy the same rights as Turkish citizens, except for the obligations of military service, voting and being elected, entering public service, duty-free vehicle importation, and other social security rights, unless regulated by law.

     

    • If the foreigner poses a serious threat to public order or security,
    • If the foreigner stays outside Turkey for more than one uninterrupted year without valid reasons such as health, education, or mandatory public service in their home country.

    If canceled, reapplication can be made either at Turkish consulates abroad or at the governorship of the province where the foreigner resides in Turkey. The application is prioritized and finalized within one month.

    A family residence permit can be issued to: a) The foreign spouse, b) The foreign minor child of the applicant or their spouse, c) The foreign dependent child of the applicant or their spouse.

     

    In the case of polygamy, only one spouse can be granted a residence permit. However, a residence permit can be granted for all of the foreigner's children. If the children have joint custody with a parent abroad, consent from that parent is required.

     

    A family residence permit allows minors to receive education in primary and secondary institutions without needing a student residence permit until the age of 18.

     

    • If a foreigner who was married to a Turkish citizen for at least three years gets divorced (this condition is waived for victims of domestic violence with court evidence),
    • If the sponsor passes away and the foreigner was living in Turkey with a family residence permit,
    • Upon turning 18, if the foreigner has lived in Turkey with a family residence permit for at least three years.

    A family residence permit can be issued for up to three years at a time and cannot exceed the duration of the sponsor's residence permit.

     

    The applicant must meet the conditions outlined in Article 35 of the law, which includes:

    • The sponsor must meet the requirements (valid health insurance covering all family members, a monthly income not less than one-third of the minimum wage per person, a clean criminal record for family-related crimes, residing in Turkey for at least one year, and being registered in the address system),
    • The applicant must provide documentation related to their stay and prove their intention to live together with the sponsor,
    • The spouses must be over 18,
    • The marriage must not have been arranged solely for the purpose of obtaining a residence permit.
    • Failure to meet the conditions for a family residence permit,
    • Use of the residence permit for purposes other than its intended purpose,
    • Existence of a valid deportation order or entry ban against the foreigner.

    Student residence permits are issued to foreigners pursuing associate, undergraduate, graduate, or doctoral studies at universities. Secondary school students can also obtain a student residence permit with their family’s consent.

     

    If you are applying for a residence permit for the first time, you must apply online through the e-residence system on www.goc.gov.tr within the visa or visa exemption period. Otherwise, your application will not be accepted.

    In all three cases, since your student status ends, you must apply for a residence permit for a new reason within 10 days from the date of termination of your relationship with the school.

     

    Any changes to your personal information (e.g., marital status, address, or passport) must be reported to the Provincial Directorate of Migration Management within 20 days.

     

    A student residence permit does not grant rights to the foreigner's spouse or children.

     
     

    Yabancı öğrencinin öğrenim süresi bir yıldan kısa ise öğrenci ikamet izni süresi öğrenim süresini aşamaz.
    Kamu kurum ve kuruluşları aracılığıyla gelerek Türkiye de öğrenim görecek yabancılara, öğrenim süresince ikamet izni verilebilir.
    Bakımı ve masrafları gerçek veya tüzel kişi tarafından üstlenilen ilk ve orta derecede öğrenim görecek yabancılara, velilerinin veya yasal temsilcilerinin muvafakatiyle öğrenimleri süresince birer yıllık sürelerle öğrenci ikamet izni verilebilir ve uzatılabilir.

    İlk kayıt tarihlerinden itibaren üç ay içinde genel sağlık sigortalısı olmak için talepte bulunan yabancı öğrencilerden ayrıca sağlık sigortası istenmez. Ancak, kayıt tarihinden itibaren üç ay içinde başvuruda bulunmayarak genel sağlık sigortalısı olma hakkını kaybedenler özel sağlık sigortası yaptırmalıdır.

     

    a) Aynı öğretim kurumunda fakülte veya bölüm değişikliği ile aynı ilde öğretim kurumu değişikliği durumunda öğrenciliğe ara verilmemesi ve süresinde bildirimde bulunulması kaydıyla mevcut ikamet izni geçerliliğini korur. İkamet izni öğrenim süresinden kısa ise iznin bittiği tarihten itibaren öğrenim süresi kadar uzatılır.
    b) Farklı bir ilde öğrenime devam edilecek olunması durumunda öğrenime devam edilecek il valiliğince mevcut ikamet izni kesilerek yeni öğrenim süresi kadar ikamet izni düzenlenir.

    Türkiye de örgün öğrenim gören ön lisans, lisans, yüksek lisans ve doktora öğrencileri, çalışma izni almak kaydıyla çalışabilirler. Ancak, ön lisans ve lisans öğrencileri için çalışma hakkı, ilk yıldan sonra başlar ancak bu öğrencilerin çalışma izni hakkında mevzuat yayınlanmamıştır. Çalışma izni başvuruları Çalışma ve Sosyal Güvenlik Bakanlığına yapılmaktadır.

     

    Öğrenci ikamet izni düzenlenmesi için aranan şartların karşılanamaması veya ortadan kalkması,
    Öğrenimini sürdüremeyeceği yönünde kanıtların ortaya çıkması,
    Öğrenci ikamet izninin veriliş amacının dışında kullanıldığının belirlenmesi,
    Hakkında geçerli sınır dışı etme kararı veya Türkiye’ye giriş yasağı bulunması, hallerinde kısa dönem ikamet izni verilmez, verilmişse iptal edilir, süresi bitenler uzatılmaz.

    Çocuğun yüksek yararı söz konusu olduğunda,
    Haklarında sınır dışı etme veya Türkiye ye giriş yasağı kararı alındığı hâlde, yabancıların Türkiye’den çıkışları yaptırılamadığında ya da Türkiye’den ayrılmaları makul veya mümkün görülmediğinde,
    Kanunun 55 inci maddesi uyarınca yabancı hakkında sınır dışı etme kararı alınmadığında,
    Kanunun 53 üncü, 72 nci ve 77 nci maddelerine göre yapılan işlemlere karşı yargı yoluna başvurulduğunda,
    Başvuru sahibinin ilk iltica ülkesi veya güvenli üçüncü ülkeye geri gönderilmesi işlemlerinin devamı süresince,
    Acil nedenlerden dolayı veya ülke menfaatlerinin korunması ile kamu düzeni ve kamu güvenliği açısından Türkiye’ye girişine ve Türkiye’de kalmasına izin verilmesi gereken yabancıların, ikamet izni verilmesine engel teşkil eden durumları sebebiyle diğer ikamet izinlerinden birini alma imkânı bulunmadığında,
    Olağanüstü durumlarda, insani ikamet izni düzenlenebilir.

    İnsani ikamet izni Bakanlığın onayı alınmak ve en fazla birer yıllık sürelerle olmak kaydıyla valilikler tarafından verilir ve uzatılabilir.

     

    İnsani ikamet izni Bakanlığın onayı alınmak kaydıyla, iznin verilmesini zorunlu kılan şartlar ortadan kalktığında valiliklerce iptal edilir ve uzatılmaz

     

    İnsani ikamet izni alan yabancılar iznin veriliş tarihinden itibaren en geç yirmi iş günü içinde adres kayıt sistemine kayıt yaptırmak zorundadır. İnsani ikamet iznine sahip olan kişiler, bu izinlerinin süresi içinde uzun dönem ikamet izni hariç olmak üzere şartlarını taşıdıkları diğer ikamet izinlerinden birisi için başvurabilirler. İnsani ikamet izni ile geçirilen süreler, Kanunda öngörülen ikamet izin sürelerinin toplanmasında hesaba katılmamaktadır.

     

    İnsan ticareti mağduru olduğu veya olabileceği yönünde kuvvetli şüphe bulunan yabancılara insan ticareti mağduru ikamet izni düzenlenmektedir.

     

    İnsan ticareti mağduru ikamet izni valiliklerce otuz gün süreli düzenlenmektedir. Düzenlenen insan ticareti mağduru ikamet izinleri en fazla altışar aylık sürelerle uzatılabilir, ancak bu süreler toplamda üç yılı geçemez.

     

    - Yabancının kendi girişimiyle, suçun failleriyle yeniden bağ kurduğunun belirlenmesi,
    - Getirilen yükümlülüklere uyulmaması,
    - Yabancının mağdur olmadığının anlaşılması durumlarında insan ticareti mağduru ikamet izni iptal edilir. Ancak sayılan durumların zorlama, korkutma, şiddet, tehdit gibi nedenlere bağlı olarak iradesinin dışında yaptığının tespiti halinde ikamet izni iptal edilmez.

    İnsan ticareti mağduru ikamet izninde diğer ikamet izinlerinin verilmesindeki şartlar aranmamaktadır.
